◊  Employment Discrimination

     We represent clients throughout the midwest and south who have been the victims of sexual harassment or of discrimination based on sex, age, race or disability.  We have successfully litigated cases against both regional corporations and major national corporations, including State Farm, WalMart, K-Mart, Prime Trucking, Sonic, and Ameren UE.

     We also offer services to smaller businesses who wish to avoid and prevent discrimination in the work place.  We advise such businesses as to the preventive measures they can take to minimize their potential exposure.

◊  Workers' Compensation

     We have litigated over one thousand workers' compensation cases over 27 years of representing injured workers.  Those cases range from slip and falls resulting in back injuries to falls from towers resulting in very serious injury or death.  We are committed not only to maximizing recovery for the injured worker, but also to providing the best advice possible to the worker’s family.  With the Missouri legislature having drastically changed workers' compensation law, it is more important today than ever before for injured workers to have counsel who aggressively seek justice on their behalf.

     We represent people who have been injured in auto accidents.  We also represent those whose injuries have been caused by unsafe conditions on property or by defective machinery and electrical equipment.  For example, we have successfully represented individuals injured as a result of falling elevators, improperly secured cell towers, collapsing trenches, and unreasonably dangerous bridges.

     When a worker is injured he may have both a workers' compensation claim against his employer and a claim against someone else who was negligent and who contributed to cause the injury.  We have the experience and expertise necessary to
pursue both types of claims.

     We have handled numerous product liability cases.  Those include cases involving auto defects, including defective seat belt, roll-over, and crush and intrusion cases, as well as cases involving unsafe electrical devices, unguarded presses, and dangerous chemicals.  Insurance companies and product manufacturers fight extremely aggressively to avoid compensating those who have been injured by defective products.  We have the experience and dedication necessary to overcome those efforts.

     No one can bring a loved one back.  However, the law does provide monetary compensation for the loss that family members sustain and will continue to sustain for the rest of their lives.  We focus on maximizing that compensation.

Class Actions

     We have represented over half a million people, including Kansas City and St. Louis taxpayers and Missouri state employees, in class actions involving denials of retirement or other employee benefits and violations of the Fair Labor Standards Act.  We have the experience necessary to understand the nuances and pitfalls of these high-stakes cases.

◊  Medical Negligence

     To maximize the ability of victims of medical malpractice to obtain a sufficient recovery, we have joined forces with lawyers in St. Louis and Kansas City in representing those who have suffered very serious malpractice-related injuries.  This approach allows our clients to have both our firm and a second firm build the case, find the best professionals to establish negligence, and obtain the relief that the damages warrant.  We have litigated medical malpractice cases throughout the state: in mid-Missouri, in Kansas City and St. Louis, and in rural Missouri.

◊  Insurance Bad Faith

     In Missouri, insurance companies can be held responsible for their breach of various duties, including the duty to insure, the duty to defend, and the duty to indemnify.  Missouri prohibits both the vexatious refusal to settle direct claims (e.g., fire loss or storm damage loss claims) and the bad faith refusal to settle liability claims.  The firm is presently litigating three multi-million dollar bad faith claims in which insurers have refused to indemnify their insureds.

     Having been approached by several defense attorneys to act as a mediator in different types of personal injury cases, we now offer mediation services throughout Missouri on a wide range of litigation topics.  We have successfully settled several case that the participants and trial judges said could “never settle.”
